Holiday rental conditions
SERVICES
The LESSEE declares to have read the descriptions of the apartment and to agree with the described state and the services offered of the holiday accommodation that the lessee has rented. The LESSEE will not have the right to claim any service that is not specified in the advertisement where the rental has been made.
OCCUPATION
The only people authorised to reside in the property, during the rental period, are the people registered in the reservation. The maximum occupancy will be that declared in the advertisement where the tenant has rented the accommodation. Tenants will not be permitted to have more than the above stated number of persons to reside or sleep on the premises. It will be essential to present the documentation of all guests for the delivery of the keys.
CHECK-IN & CHECK-OUT
The lease will begin at 4:00 p.m. on the date indicated above as check-in date and expires at 10:00 a.m. on the date indicated above as check-out. The LESSEE undertakes to notify us of his approximate arrival time at least 24 hours in advance. On the day of arrival, the LESSEE will confirm to Nerja Property Services & Frigiliana Real Estate one hour before arrival the exact time. Nerja Property Services & Frigiliana Real Estate will receive the LESSEE at the tourist accommodation and give all the necessary instructions. Essential for check-in: to enter the accommodation it is essential to bring an official identification document for each person and also if you have paid for the reservation by credit card, it is essential that the person who paid with the card is present at the time of entry and have the physical credit card with your identity document. In case of not being able to verify the card, the amount paid will be refunded to the card not present and the LESSEE will have to make the full payment of the rent in cash or with another credit card. Nerja Property Services & Frigiliana Real Estate will charge €30 for credit card expenses and the LESSEE will not be entitled to compensation or discounts for additional expenses by their bank for the return and new payment. Check-in will be from 4:00 p.m. to 10:00 p.m. Tickets between 10:00 p.m. and 12:00 a.m. will have an additional cost of €50. Entry from 24:00 h will have an additional cost of €100. The maximum entry time is at 02:30 h. The maximum departure time from the accommodation will be at 10:00 h. Each hour of delay not confirmed in writing by Nerja Property Services & Frigiliana Real Estate will be charged from the deposit with €50 per hour.
RENT
The total price agreed for the rental contract is the amount indicated that must be paid in advance. The LESSEE at the time of reservation will pay 25% for the reservation of the property and the pending amount will be paid 40 days before arrival (including the deposit amount). Nerja Property Services & Frigiliana Real Estate will contact the LESSEE to notify him of the non-payment of his reservation. If the LESSEE does not make the payment within 48 hours from the first notice, the reservation will be automatically canceled without refund of the first payment. Cleaning costs are included in the final rental price.
SECURITY DEPOSIT
The security deposit will be kept against any damage caused to the property and the effects of furniture and accessories existing in it, as well as for any unpaid invoice that falls on the TENANTS. If Nerja Property Services & Frigiliana Real Estate does not have to retain any of the deposit, the return of the damage deposit (Deposit) will be made up to 7 days after departure (Nerja Property Services & Frigiliana Real Estate is not responsible for the time that the bank late in making the return). If the apartment is damaged after the stay, Nerja Property Services & Frigiliana Real Estate will have one week to assess the damage and notify the LESSEE of the repair or replacement costs that will be charged. If the LESSEE has made the payment of the deposit through bank transfer, it will be his/her responsibility to communicate his/her bank details, to which he/she wants Nerja Property Services & Frigiliana Real Estate to make the return. Nerja Property Services & Frigiliana Real Estate will return the deposit within 7 days after the stay. Nerja Property Services & Frigiliana Real Estate will have an additional 48 hours to make the transfer from the moment of receipt of the bank details.
Any damage caused to the building as a result of omissions, negligence will be repaired by the owner at the expense of the LESSEE who is held responsible for the person who causes it.
Without the prior written permission of the owner or agent, the LESSEE will not be allowed, under any circumstances, to carry out any type of work on the property. The authorised works carried out by the LESSEE will remain for the benefit of the property at the expiration of this agreement, and the LESSEE will not be entitled to any type of claim or compensation. In case of unauthorised works, the LESSEE has the obligation to return everything in its original condition and any cost for it will be borne by the LESSEE.
USE OF THE ACCOMMODATION
The LESSEE will not allow the accommodation to be used for any auction or any immoral purpose and will not suffer or allow to be done any act or thing that could be a damage or nuisance to the owner or any occupant of any adjacent or nearby Property. Nor will it install commercial facilities, nor carry out any commercial or professional activity. Failure to comply with this clause leads to the termination of the contract immediately without any right to claim or compensation for the rent and loss of the deposit.
PROPERTY CONDITION
The accommodation is rented free of charge and occupants. The LESSEE knows and accepts the surface, the circumstances, the use, the characteristics and the common and private services of the tourist accommodation and declares to receive the goods object of this contract in perfect conditions for the use detailed above. THE LESSEE undertakes to return the accommodation in the same conditions and with full satisfaction at the expiration of the contract. Any obvious breakage or defect must be notified to Nerja Property Services & Frigiliana Real Estate at the beginning of the rental contract with Photos.
SUBLET
In no case will the LESSEE be allowed to sublease or assign all or part of the property object thereof, nor bring any additional person to the property without the prior express written consent of Nerja Property Services & Frigiliana Real Estate.
ACCESS
The LESSEE agrees to allow Nerja Property Services & Frigiliana Real Estate access to the property, with or without, workers and others at all responsible times during the rental period. Nerja Property Services & Frigiliana Real Estate undertakes to give prior written notice of access.
PETS
The tenant agrees not to retain animals, birds, fish or pets in the properties without specific written authorisation. We need you to tell us the breed and weight of your pet. Authorised PETS are totally prohibited from climbing on the furniture and/or bathing in the pool. In addition, the LESSEE undertakes to collect the feces from the garden daily (if the property has a private garden) and to leave the garden free of pet feces before departure. Additional cleaning costs for breach of this clause will be charged from the deposit and may lead to the full loss of the deposit.
SECURITY
The LESSEE agrees not to leave the property unoccupied for any period without locking and securing all doors, windows or any other means of entry to the property and, if available, they will always activate the alarm when leaving the property. Nerja Property Services & Frigiliana Real Estate and/or the Owner will not be responsible for the loss of the tenant's personal items, this contract does not include any type of insurance for the loss or theft of the TENANTS' items. In case of theft: If the property was not properly closed and the alarm (if available) connected, the LESSEE will cover all damage caused to the accommodation by theft with the deposit.
KEYS
The tenant must leave the keys of the property on the table and close all the doors and windows of the property when leaving.
The loss of a key without a Garage remote has a cost of €20 per key on the keychain. The loss of a remote control, magnet or parking card has a cost of €60. Nerja Property Services & Frigiliana Real Estate will notify the LESSEE no later than 24 hours after departure of the lack of a key and the corresponding amount will be charged from the deposit. Forgotten keys in the accommodation during your stay: if the LESSEE forgets the keys inside the apartment during business hours and cannot enter, Nerja Property Services & Frigiliana Real Estate will open it with the Service key. This service has a cost of €30. If the key is on or the LESSEE forgets the keys outside of working hours, the LESSEE has to pay the locksmith's expenses for the recovery of the keys and, if applicable, replacement of the lock.
CANCELLATION POLICY
In case of cancellation of the reservation by Nerja Property Services & Frigiliana Real Estate, it is obliged to return the full amount from the LESSEE up to that moment. In addition, Nerja Property Services & Frigiliana Real Estate will do everything possible to relocate the LESSEE in accommodation with the same or similar characteristics.
Cancellation by the LESSEE:
At least 30 days before check-in, you will receive a 100% refund.
Less than 30 days before check-in, you will receive no refund.
If the LESSEE cancels his reservation due to COVID restrictions, other dates will be offered in the same property or in another with similar characteristics.
If the LESSEE cancels the reservation before entering the accommodation, the payments made for deposit and cleaning will always be returned. If the LESSEE cancels while already in the Property, the rent and cleaning payments will not be refundable and the deposit is returned after the corresponding checks.

We would also like to inform you that we contracted the service/real estate software called "InmoShare : Plataforma de Marketing y Gestión Informática Inmobiliaria" (hereinafter "InmoShare") of the company Real2Soft Sistemas de Gestión Integral, S.L. (hereinafter "Real2Soft") whom, until termination of said contract and while the domain nerjapropertyservices.com points to it's servers, it is enabled as MANDATED in charge of maintenance and support of the aforementioned data servers. These servers provide, in turn, both the web hosting as well as the networks, systems, applications and databases (and whenever appropriate email hosting) used and provided by "InmoShare", which, when used for said purpose, provide the necessary support for the storage and confidential treatment of data BY "NerjaPropertyServices".
